These Terms of Service ("Terms") govern your access to and use of SummitScore ("the Service"), operated by SummitScore ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.
By accessing or using the Service, you confirm that you are at least 13 years of age and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

The Service is provided free of charge. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.
To use most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You may delete your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or are used in a manner that could harm the Service or other users.

You retain ownership of all data you provide to the Service, including your profile information, hike records, and any content you create. By using the Service, you grant us a limited, non-exclusive license to store, process, and display your data as necessary to provide the Service.
Certain information you provide — including your display username, bio, and hikes marked as public — may be visible to other registered users of the Service. You can control the visibility of your hikes through your profile settings.
We reserve the right to remove any user content that violates these Terms or that we determine, in our sole discretion, is harmful, objectionable, or otherwise inappropriate.
The Service allows you to connect third-party accounts including Strava and Oura Ring. When you authorize a connection, you grant us permission to access and import data from that service in accordance with the permissions you approve.
Your use of third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices, content, or availability of third-party services.
You may disconnect any third-party integration at any time through the Integrations page. Disconnecting a service revokes our access to new data from that service but does not automatically delete data already imported into SummitScore.
Performance scores, predictions, trail difficulty ratings, and other analytics provided by the Service are calculated using automated algorithms and are intended for informational and recreational purposes only.
SummitScore scores are not medical advice, fitness prescriptions, or safety assessments. You should not rely on SummitScore data to make decisions about your health, safety, or physical capability. Always exercise your own judgment when planning and undertaking outdoor activities, and consult a medical professional regarding any health concerns.
The Service, including its design, code, scoring algorithms, visual elements, and branding, is owned by SummitScore and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data or scores will be accurate or complete. We do not guarantee the availability or accuracy of data from third-party services.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUMMITSCORE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
You agree to indemnify, defend, and hold harmless SummitScore and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
Hiking and outdoor activities involve inherent risks, including but not limited to injury, illness, and death. SummitScore is an analytics tool and does not provide safety guidance, route planning advice, or fitness recommendations.
You acknowledge that you are solely responsible for your own safety when engaging in outdoor activities. SummitScore shall not be held liable for any injury, loss, or damage that occurs during or as a result of any outdoor activity, regardless of whether you used the Service before, during, or after such activity.
We may revise these Terms at any time by updating this page. Material changes will be indicated by updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and SummitScore regarding the use of the Service and supersede any prior agreements.
